Is payload capacity the same as legal cargo weight?
No. It is the gross-rating remainder. A load can be below GVWR while overloading a steer, drive, trailer or tire limit.
Should fuel be included in empty weight?
Use the fuel already on board in the scale weight. Add only fuel that will be loaded after that weighing.
